2010 Primary Election Rules: Results and Write-Ins

1. Independent Party will announce the raw official data results (votes talled by computer for candidates whose names appear on the ballot and the raw recode of write-in votes in each contest) in the evening of Friday, July 30.

2. If the total number of write-in votes for candidates for the same nomination equals or exceeds (a) the difference between the votes cast for the two candidates with the highest number of votes whose names are printed on the ballot or (b) the votes cast for the only candidate whose name is printed on the ballot, then the names of the write-in candidates shall be reviewed, counted, and announced as soon as possible after release of the raw results.

3. The Independent Party shall seek to determine the intent of the voter in reviewing any misspelling, typographical error, or ambiguity in any write-in vote, and that determination shall become part of the official election results.

4. If a candidate or campaign disputes the determination of the Independent Party regarding a voter's intent in writing in a particular name, that dispute will be reviewed by an arbitrator chosen by the Independent Party State Council. The arbitrator shall be a member of the Oregon State Bar and not a member if the Independent Party. The arbitrator's decision shall be final and shall become part of the official election results.
